Dutch Gambling Authority Issues Warnings to 13 Operators

The Dutch gambling authority, Kansspelautoriteit (KSA), has recently issued directives to several gambling operators to enforce adherence to payout regulations. This action follows an investigation which revealed that 13 licensed operators were not fully compliant with the payout requirements set by the Dutch Gambling Act.

Investigation Insights

The KSA’s thorough investigation discovered that nine online gambling operators were deliberately obstructing customer payout requests. Furthermore, four additional operators were suspected of similar practices. The Dutch Gambling Act mandates that payout requests from players must be processed immediately and without any conditions to ensure players have quick access to their winnings and to protect them from undue delays.

Regulatory Actions

These discrepancies were identified after the KSA issued a reminder in March 2024 about the regulatory requirements. The authority provided explicit examples of non-compliant behaviors, such as setting minimum payout amounts and requiring players to meet certain wagering conditions before they could withdraw their winnings. These practices contravene the Dutch Gambling Act's aim to guarantee fair treatment for all players.

Legislative Requirements

Under the act, all licensed operators are obliged to process payments securely and distribute player credits promptly. It stipulates that when a player requests a payout, the operator must debit the gaming account and credit the player’s account immediately, highlighting the law’s focus on protecting consumer rights within the Netherlands.

In response to these findings, the KSA has required all identified operators to submit written confirmation that they are not imposing any restrictive conditions on player payouts. This directive ensures full compliance with the Dutch Gambling Act and the protection of player rights.

KSA’s Stance on Compliance

The KSA emphasized the importance of operators not imposing any structural conditions that could hinder the direct payment of player credits. In a formal statement, the regulator reiterated its commitment to enforcing these rules, stating, "A provider may not impose structural conditions that prevent direct payment. Player credits must therefore be refunded without unnecessary delay."

Ongoing Oversight and Commitment

The KSA continues to actively oversee the implementation of the Dutch Gambling Act, ensuring that all licensed operators meet the strict requirements for secure payment processing and prompt credit distribution. The regulator's proactive approach helps maintain the integrity of the Dutch gambling market and protects consumers from unfair practices.

In July 2024, KSA chairman Michel Groothuizen commended the licensed operators for their compliance with the regulations, particularly during the UEFA Euro 2024 tournament, a period of heightened gambling activity. He noted that nearly all operators had adhered to the rules and demonstrated a commitment to responsible gambling.
